: (1) When appointing a person to the position of a worker or employee, the tea plantation may ask that person to submit a health certificate issued by a doctor recognized by the Government of Nepal regarding his health. If such a person is unable to submit such a health certificate, the tea garden will not be obliged to appoint him.
(2) The tea garden may, if it deems it appropriate to appoint a person as a worker or employee, conduct a health examination of such person by a doctor recognized by the Government of Nepal.
